A federal judge has ordered the Food and Drug Administration to pay a $2 billion fine for illegal drug marketing and to pay the drug maker $3.5 billion to settle civil charges related to its unlawful marketing of Viagra.
Under federal court rules, the company is required to notify the FDA of a similar warning. The fine amounts to $3.5 billion, or $2.8 billion, to the drug maker.
The FDA has said the drug maker did not receive the notice of the violation and has refused to comply with the fine.
The FDA is also required to pay $1.2 billion to a partner of the company to resolve civil claims related to its unlawful marketing of Viagra, the company said. That settlement will be filed under seal in the U. S. District Court for the Southern District of Florida.
The company said the fine is based on the company’s failure to comply with the applicable laws. However, the fine has not been determined, according to the company.
The company says it will not pursue criminal liability for the illegal marketing of Viagra, citing its illegal marketing of Viagra in connection with the investigation.
The drug maker said it has reached settlements with other drug makers. A similar settlement has been reached with the maker of Lipitor and Viagra.
“While the FDA has been satisfied with the outcome of the investigation, we are satisfied that the company will vigorously pursue criminal charges related to its unlawful marketing of Viagra,” said Amy Schauer, a spokeswoman for Pfizer Inc.
The company will continue to market Viagra to physicians who prescribe it.
“Any civil suit in this case should be dismissed. Allowing the company to continue to market this drug to physicians who prescribe it to their patients violates the law,” Schauer added.
The company has also said it has refused to reimburse the company for any claims it may have brought regarding the illegal marketing of Viagra.
According to the company, it has not paid any of the company’s attorneys fees.
“The company is not a party to this litigation,” Schauer said.
